1. Acceptance of Terms

By downloading, installing, accessing, or using the LingerLoom mobile application (the “App”), you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service and our Privacy Policy. If you do not agree to any of these terms, do not use the App.

2. Description of Service

The App is a free, non-commercial, local offline peer-to-peer secondhand trading platform that provides information services only:

• Post and browse secondhand item listings
• In-app user communication and chat
• Arrange offline in-person transactions at your own risk

The App guarantees:

• Completely free to use, with no advertisements, in-app purchases, or paid features
• No external links, redirects, or third-party websites
• No payment processing, delivery responsibilities, or transaction guarantees
• Not acting as a seller, buyer, agent, or intermediary; providing an information platform only

3. User Eligibility

• You must be at least 13 years old to use the App.
• If you are under 18, you must use the App under the supervision and with consent of a parent or legal guardian.
• You warrant that you have full legal capacity to use the service.

4. User Accounts and Code of Conduct

You agree and warrant that:

• You will provide true, accurate, and non-misleading account and item information.
• You will not create multiple accounts, impersonate others, or misuse accounts.
• You will not use the App for illegal, harmful, infringing, or fraudulent activities.
• You will not list prohibited items, including but not limited to: illegal items, stolen property, weapons/ammunition, drugs, counterfeit goods, adult sexual content, hazardous materials, alcohol, tobacco, prescription drugs, wildlife products, gift cards/vouchers, and any items that violate laws or third-party rights.
• You will not harass, threaten, abuse, or defraud other users.

5. Content and Moderation

• You retain ownership of content you post, but grant us a limited license to display, store, and transmit such content to provide the Service.
• We use automated and human moderation and reserve the right to remove prohibited or inappropriate content.
• You may report and block users who violate these terms.
• We reserve the right to remove violating content, suspend or terminate accounts without prior notice.

6. Offline Transactions and Disclaimer

All transactions are conducted exclusively offline and in person directly between users. The platform does not participate, oversee, or guarantee any transactions.

We assume no liability for:

• The condition, safety, legality, authenticity, or quality of items
• Payment, delivery, performance, or disputes in any transaction
• Personal injury, property loss, or damage resulting from offline meetings or transactions

You engage in transactions entirely at your own risk. Recommendations: meet in public places, inspect items carefully, exchange payment securely, and protect personal safety.

7. Intellectual Property

The App itself (including software, design, trademarks, interface, and documentation) is our exclusive intellectual property. You may not copy, modify, reverse-engineer, distribute, or crack the App.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

• We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App or offline transactions.
• The App is provided free of charge, with no express or implied warranties.

9. Indemnification

You agree to indemnify us against any claims, losses, and expenses resulting from your breach of these Terms or your conduct.

10. Termination

• We may suspend or terminate your account at any time for violations without notice.
• You may stop using the App and delete your account at any time.

11. Modifications to Terms

We may update these Terms. Material changes will be announced in the App at least 30 days in advance. Your continued use constitutes acceptance of the revised terms; if you do not agree, you may stop using the App and delete your account.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA, and applicable federal law, without regard to conflict of law rules. Disputes arising from this Agreement shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to individual arbitration in California, and you waive your right to participate in class actions.
